1. About these terms

These terms govern the use of the website https://onsite.no and the OnSite app at https://app.onsite.no (“OnSite”), provided by On-Site AS (org. no. 828 410 172), Standardveien 1, 0581 Oslo, Norway (“we” or “us”). By using the website or the app you accept these terms. If you do not agree, please do not use OnSite.

If you use OnSite through an employer or a project that has an agreement with us, that agreement also applies and takes precedence over these terms in case of conflict.

2. The service

OnSite is an app for registering and informing workers on construction projects. Workers create a profile, register information such as their HSE card and certificates, join projects and receive project information. Project administrators approve memberships and document that only qualified personnel gain access to the construction site.

3. User account

  • You must be at least 16 years old and provide accurate information about yourself.
  • You are responsible for keeping the information in your profile correct and up to date.
  • Your sign-in is personal and must not be shared with others.
  • You must not upload documents that do not belong to you, or give false information about competence, certificates or HSE cards.

4. Projects and sharing of information

When you request to join a project, your profile, including the documents you have registered, becomes available to that project's administrators. The project is responsible for how it uses the information. How we process personal data is described in the privacy policy.

5. Acceptable use

You must not:

  • use OnSite for anything unlawful or contrary to these terms,
  • attempt to gain unauthorised access to the service, other users' accounts or our systems,
  • copy, modify, decompile or create derivative works of the service,
  • use automated tools to extract data from the service, or
  • use the service in a way that could damage, overload or impair it.

6. Intellectual property

OnSite, including its software, design, trademarks and the text and images on the website, is owned by On-Site AS or our licensors. You receive a limited, non-exclusive and revocable right to use the service for its intended purpose. You keep ownership of the content you register yourself, but grant us the right to store and display it as the service requires.

7. Third-party services

The website and the app link to or use third-party services, such as demo booking through Calendly and sign-in through identity providers. Those services have their own terms and privacy policies, for which we are not responsible.

8. Availability and liability

We work to keep OnSite available and working as described, but the service is provided “as is”. We do not guarantee that it is error-free or always available, and we may change or discontinue features. The website and the information on it are provided free of charge, and we are not liable for loss arising from use of the website.

To the extent permitted by applicable law, our total liability towards you is limited to direct loss, and we are not liable for indirect loss such as lost profit, lost data or business interruption. Nothing in these terms limits liability that cannot be limited under mandatory law.

9. Privacy

How we process personal data is described in the privacy policy, which forms part of these terms.

10. Termination

You may stop using OnSite at any time and ask us to delete your account. We may suspend or restrict your access if you breach these terms, or where necessary for security or legal reasons.

11. Changes

We may change these terms. Material changes are announced in the app or by email before they take effect. Continued use after the changes take effect constitutes acceptance of the new terms.

12. Governing law and venue

These terms are governed by Norwegian law. Disputes that cannot be resolved amicably are to be settled by the Norwegian courts with Oslo District Court as the venue, unless mandatory law entitles you to another venue.
